"We watched as they carried that baby's body out and we never want ever want that to happen to another child because we didn't do anything," said a neighbor.
Many neighbors say they saw bruising, neglect - all the signs of abuse.
"I think a lot of people are intimidated, or they're not sure if it's really something they should be worried about. What I always tell people is follow your gut," said Ann Stevens with the Montgomery County Department of Job and Family Services.
Stevens says when in doubt, make the call. "If our gut tells us something's a little bit off. Have somebody check it out. children services can take the information anonymously," said Stevens.
Jason Durig - Caleb's father - has a history. Back in 2007, he was sentenced to 18 months in jail for child endangering. Officials say he scalded his then one month old infant who was taken away. So did officials know the Durig's had another child and did they keep track? Miami County Prosecutor Gary Nasal says he cannot comment.
When asked if Durig did counseling or any anger management as part of his sentence. Nasal said, "The court did not order any special conditions relative to his interrelation with children"
Miami County Children Services talked to Dayton's News Source over the phone and offered this statement. "The death of any child is tragic, without a doubt. We are in the middle of the investigation and cannot comment any further," said Debbie Sandlin.
"It might be too late for Caleb but maybe this was his purpose that everybody can speak out now so that you know if something isn't looking right or sounding right. You speak out so that that next baby is still here," said Amber Temple, one of the grieving members of the community.
